1.About these terms

Driving Test Cancellations 4 All, a trading name of Theory Training Solutions Ltd ("the company", "we", "us"), provides its driving test swap service to you subject to the following terms and conditions, which you accept by using the service.

Your attention is drawn in particular to the provisions of clauses 5, 6 and 10.

These terms apply to the swap service only. They do not replace or vary any other terms you have agreed with us for any other service.

2.The service is provided as available

All software and services are provided by Theory Training Solutions Ltd, and are on an "as available" basis with no warranties of any kind.

3.The waiting list

Places on the swap service are released in waiting list order. Joining the list holds your place; it does not guarantee you a swap, and we make no commitment as to when you will reach the top or whether a suitable match will exist when you do.

4.What we do

Our role is limited to identifying another learner driver whose booked driving test you may wish to swap with, checking that a swap between you would meet the DVSA's rules, and giving each of you the other's DVSA booking reference so that the swap can be requested.

5.What we do not do

The company has no affiliation with the Driver and Vehicle Standards Agency (DVSA).

We never contact the DVSA on your behalf. We never log in to the DVSA website using your details, and we never ask you for your driving licence number. We never change, swap or cancel your driving test.

Any swap is made by the DVSA, by telephone. One of the two learners calls the DVSA and gives both booking references; the DVSA then telephones the other learner on the number registered against their booking. Both learners must agree to the DVSA's declaration before the swap is made.

6.Your responsibilities before making arrangements

It is your responsibility to check with the DVSA that a swap has been completed successfully before you make any further arrangements regarding your new driving test, such as but not limited to 1) organising and paying for any driving lessons, 2) organising and paying for any transport to the test centre, 3) organising and paying for any accommodation near the test centre, and 4) taking time off work, college or school.

The DVSA will confirm any change to you if they have your email address. You must wait for that confirmation before you start to make plans and preparations for your new driving test. We are not liable for any expenses or compensation caused by you incorrectly assuming your test has been changed.

The learner driver is responsible for turning up to the driving test.

7.Eligibility

Swaps are subject to the DVSA's own rules, which may change. At the time of writing these include a minimum of 10 full working days' notice before the earlier of the two tests, a limit of two changes per booking, restrictions on which test centres you may swap to, and a requirement that the two tests are of the same type. It is your responsibility to check that you are eligible before requesting a swap.

8.Your information

You must give us accurate details about yourself, about the driving test you have booked, and about the test you would accept in its place, and keep them up to date. We may be unable to match you, or may match you unsuitably, if your details are wrong.

We will record details of usage of the service including, but not limited to, the personal details provided when you joined the waiting list, the driving test details you give us, matches we identify for you, and emails and text messages that are sent to you and received from you.

By registering your details with the company, you agree to the company sending emails and text messages to the email address and mobile telephone number you provide.

9.Other learners' information

We never share your driving licence number, address, telephone number or email address with another learner driver, and you must not share yours with them. The only detail that needs to be exchanged to make a swap is a DVSA booking reference number.

You must use another learner's booking reference only to request the swap we have matched you for, and for no other purpose.

10.Matters outside our control

We cannot be held responsible for the DVSA changing the date or time of your test, or for the DVSA cancelling the test.

We cannot be held responsible for failing to match you, or for a matched swap not completing, due to factors outside our control, including the availability or decisions of the other learner and the availability of the DVSA's telephone service.

Save in respect of those liabilities which cannot legally be limited, the company shall have no liability to you for its failure or inability to find you a swap.

11.Your account

We create an account for you and email you a generated password. You are responsible for keeping that password secure, and we recommend changing it when you first log in.

Each account may only be used for the driving test held by the person who created it. We reserve the right to suspend accounts where we believe an account is not being used as intended.

Our service contains features that allow us to monitor accounts to ensure that we are providing the best possible service for you.

12.Fees

Joining the waiting list is free. If the swap service introduces a charge, we will tell you what it is before you are asked to pay anything.

13.Proper use of email and text messages

The integrity of this system relies on proper use of email and text messages as a message passing media. The use of the email or text message systems, directly or indirectly, as a spamming tool, or other than as intended, is prohibited.

14.Copyright

All content included on this site, including text, graphics, logos, button icons, images and software, is the property of the company or its content suppliers and is protected by international copyright laws. 15.Notices

The company may send notices to you via either email or regular mail. The company may also provide notices of changes to these terms or other matters by displaying notices, or links to notices, to you generally on the services provided by the company.

16.Changes to these terms

If these terms change we will publish a new version and ask you to accept it. The version you accepted, and the date you accepted it, are recorded against your account.
