Privacy Policy

The Driving Test Cancellations 4 All driving test swap service is provided by Theory Training Solutions Ltd.

This Privacy Policy explains how Theory Training Solutions Ltd ("Theory Training Solutions Ltd", "we", "us", or "our") collects, uses, and discloses your information. The Privacy Policy applies to the driving test swap service. Our other products and services have their own Privacy Policy.

Where applicable, you consent to the use of your information as described in this Privacy Policy each time you use our products or services, so we urge you to read this document in full, and to contact us at support@driving-test-cancellations-4all.co.uk if you have any questions.

Definition of "personal information"

Personal information is information that can be used to directly or indirectly identify you. Personal information also includes anonymous information that is linked to information that can be used to directly or indirectly identify you. Personal information does not include information that has been irreversibly anonymised or aggregated so that it can no longer enable us, whether in combination with other information or otherwise, to identify you.

The kinds of information that we collect

Information you provide. When you join the driving test swap waiting list we collect your first name, last name, email address and mobile number, and the details of the driving test you already hold: test centre, date, time, test type, whether you have extra time arranged, and your DVSA booking reference. We also collect what you tell us about the test you want: the dates you would accept, the test centres you would accept, and the days and times you could take a test.

Information about payments. Joining the waiting list is free and we do not take a payment for it. We do not collect or store your payment details. If we ever charge for the swap service we will tell you what the charge is before you pay anything, and this policy will be updated first.

Information about use of our services and products. When you visit our website we may collect information about the type of device you use, the IP address of your device, your operating system, the type of Internet browser that you use, usage information, diagnostic information, browsing information and session summary information. We may gather some of this information automatically.

Information from third parties. We do not collect information about you from marketing partners, social networks or any other third party. Everything we hold about you, you gave us yourself.

What we do not collect. We do not ask for your driving licence number, your theory test certificate number, your home address, your GOV.UK sign in details or any payment card details. You will need your licence number and payment card on the call to the DVSA, but you give those to the DVSA, never to us.

How we use this information

Generally speaking, we use personal information to provide, improve, and develop our products and services, to communicate with you, and to protect us and our users.

Theory Training Solutions Ltd collects, processes, and determines how to process your personal information as data controller for the following purposes:

Running the waiting list and matching you. We use your test details to work out where you sit in the queue and to look for a learner whose test you want and who wants yours, and to check that a swap between you would meet the DVSA's rules. Lawful basis: performance of a contract with you.

Communicating with you. We use your email address and mobile number to send you your login details, to tell you when you reach the top of the list, and to tell you when we have found you a match. Subject to your prior express consent, we may also send you marketing communications in relation to Theory Training Solutions Ltd's own products and services. If you no longer wish to receive email communications for marketing purposes, contact us at support@driving-test-cancellations-4all.co.uk to opt out.

Providing, improving, and developing our products and services. We use personal information to help us provide, improve, and develop our products and services. This includes using personal information for purposes such as data analysis, research, and audits. Such processing is based on our legitimate interest in offering you products and services and for business continuity.

Promoting safety and security. We use personal information to help verify accounts and user activity, as well as to promote safety and security, such as by monitoring fraud and investigating suspicious or potentially illegal activity or violations of our terms or policies. We use a CAPTCHA on our forms to deter automated sign ups. Such processing is based on our legitimate interest in helping ensure the safety of our products and services.

Cookies

How your information is shared

The learner you are matched with. When we match you, we give the other learner your DVSA booking reference and we give you theirs. That is the only thing we pass on. We never give them your name, your email address or your phone number, and we never give you theirs.

Why the booking reference has to be shared. It is what makes the swap possible while keeping you anonymous. The caller gives the DVSA both references; the DVSA looks up the other booking and rings that learner on the number it already holds. On its own a booking reference identifies a test slot, not a person, and it cannot be used to change or cancel a booking without the licence number and payment card that go with it.

The DVSA. We are not the DVSA and we are not affiliated with the DVSA, DVLA or GOV.UK. We do not contact them about your booking and we do not pass your information to them. You deal with the DVSA yourself.

Service Providers. We share personal information with companies that provide services on our behalf, such as website hosting, email services, text message delivery, data analytics and providing customer support. These companies are obligated to protect your information and may be located wherever we operate.

Corporate Affiliates and Corporate Business Transactions. We may share personal information with all Theory Training Solutions Ltd-affiliated companies. In the event of a merger, reorganization, acquisition, joint venture, assignment, spin-off, transfer, or sale or disposition of all or any portion of our business, including in connection with any bankruptcy or similar proceedings, we may transfer any and all personal information to the relevant third party.

Legal Compliance and Security. It may be necessary, by law or as a result of legal process, litigation, or requests from public or governmental authorities within or outside your country of residence, for us to disclose personal information. We may also disclose personal information if we determine in good faith that disclosure is reasonably necessary to protect our rights and pursue available remedies, enforce our terms and conditions, investigate fraud, or protect our operations or users.

We do not sell your personal information, and we do not share it with third parties for their own marketing purposes without your prior express consent.

Your rights

We take reasonable steps to ensure that your personal information is accurate, complete, and up-to-date. Depending on where you live, you may have the rights described below.

You can help us maintain the accuracy of your information by notifying us of any changes to your account details. You can do this yourself on the My details and My driving test pages once you are logged in.

You have the right to access, correct, or delete the personal information that we collect. You are also entitled to object to or restrict, at any time, the further processing of your personal information. You have the right to receive your personal information in a structured and standard format. You may lodge a complaint with the Information Commissioner's Office regarding the processing of your personal information.

To protect the privacy and the security of your personal information, we may request information from you to enable us to confirm your identity and right to access such information, as well as to search for and provide you with the personal information we maintain. There are instances where applicable laws or regulatory requirements allow or require us to refuse to provide or delete some or all of the personal information that we maintain.

You may contact us at support@driving-test-cancellations-4all.co.uk to exercise your rights. We will respond to your request in a reasonable timeframe, and in any event in less than 30 days.

Closing accounts

We will retain your personal data until you request that your account be closed. If you wish to close your account, please email us at support@driving-test-cancellations-4all.co.uk.

Once your account is closed, we have no obligation to retain your personal data and may delete any or all of it without liability. However, we may keep certain information if we believe it is necessary to prevent fraud or future abuse, if required by law, or for legitimate purposes, such as analysing non-personal information, account recovery, auditing our records, or enforcing our rights and obligations under agreements.

Third party websites and services

Our websites may contain links to third-party websites, products, and services. We are not responsible for the privacy practices employed by those third parties, nor are we responsible for the information or content their products and services contain. This Privacy Policy applies solely to information collected by us. We encourage you to read the privacy policies of any third parties before proceeding to use their websites, products, or services.

Data security and retention

All information you provide to us is stored on secured servers in the UK. However, please be aware that transmitting data over the internet is never completely secure and is done at your own risk.

Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site. Once we receive your information, we use strict procedures and security features to try to prevent unauthorised access.

We generate your password for you and store it only as a one way hash. We never store your password in a form we can read, and nobody here can tell you what it is. If you lose it, we can only replace it.

It is important that you take precautions to protect against unauthorised access to your account credentials, and computers or other devices. If you feel that the security of your account or personal information has been compromised, please contact us immediately. Please be aware that, despite our efforts, no security system is impenetrable. In the event of a security breach, we will promptly notify you and the proper authorities if required by law.

How long do we store your personal data?

We will keep your personal data for as long as you use our services or until you request that we close your account, unless a longer retention period is required or permitted by law. If you wish to close your account, please email us at support@driving-test-cancellations-4all.co.uk.

Children

We do not knowingly collect, use, or disclose information from children under 18. If we learn that we have collected the personal information of a child under 18, we will take steps to delete the information as soon as possible. Please immediately contact us if you become aware that a child under 18 has provided us with personal information.

Changes to this privacy policy

We may periodically change this Privacy Policy to keep pace with new technologies, industry practices, and regulatory requirements, among other reasons. We expect most such changes to be minor. Any non-material changes will take effect immediately upon posting of an updated Privacy Policy. There may, however, be cases where changes to the Privacy Policy may be more significant. In such cases, we will provide you either a prominent notice of such changes before they take effect or by directly sending you a notification.

Your continued use of our products and services after the effective date of the Privacy Policy means that you accept the revised Privacy Policy. If you do not agree to the revised Privacy Policy, please refrain from using our products or services and contact us to close any account you may have created.

Essential cookies

These cookies are strictly necessary for the site to work and cannot be switched off.

ASP.NET_SessionId keeps you logged in as you move from page to page, and holds the answer to the CAPTCHA on our forms so that we can check what you typed. It expires when you close your browser. If you block it you will not be able to log in.

CookieConsent remembers your answer to the cookie banner, so that we do not ask you again on every page. It is set by Cookiebot, the consent tool that runs the banner.

Performance and functionality cookies

These cookies are used to enhance the performance and functionality of our site but are non-essential to its use. This site does not currently set any cookies of this type.

Analytics and customization cookies

These cookies collect information that is used to help us understand how our site is being used, or how effective our marketing campaigns are.

analytics_sid is set by our own analytics software, which runs on our own servers. It tells one visit apart from another so that we can count visits and see which pages are used. That data is not sold and not shared with advertisers.

Google Analytics cookies, whose names begin _ga, are set by Google on our behalf. They tell us how many people join the waiting list and which pages they arrived from. We do not use them to build a profile of you, and we have turned off the settings that would allow Google to use the data for personalised advertising.

Social networking cookies

These cookies are used to enable you to share pages and content on third party social networking websites. This site does not embed social networking buttons and does not set cookies of this type.

Third party cookies

Google. We use Google Analytics to measure how the site is used, and Google Ads to measure whether our advertising brings people here. Both are loaded from Google's servers and set their own cookies. We send Google a signal on every page telling it not to use your data for personalised advertising or to share it for advertising purposes.

We do not embed social media trackers, and we do not sell your information to anyone.

Controlling and opting out of cookies

You can control and manage cookies in your browser settings. Removing or blocking cookies can impact your user experience and parts of this site may no longer be fully accessible. In particular, if you block the session cookie you will not be able to log in.

Most browsers allow you to see what cookies you have and delete them individually, block cookies from particular sites, or block all cookies. Your browser's help pages explain how.

Do not track

Some browsers offer a "do not track" setting. There is no accepted standard for how a site should respond to that signal, so this site does not currently respond to it. We will keep this under review as the standards settle.
